• Location Data: If you use our site planning features, you may provide property addresses or coordinates to import satellite imagery.
• Design Preferences: Text prompts and descriptions you provide to customize your landscape designs.
• Payment Information: We use Stripe to process payments. Your payment card details are collected and processed directly by Stripe and are never stored on our servers.
• Client Information (B2B): If you use our business features, you may provide client names, contact information, and property details within project management tools.
• Company Information: Business plan users may provide company name, logo, contact details, and branding preferences for white-label features.
• Proposals: Pricing estimates, project descriptions, and other content entered into the proposal builder.

1.2 Information Collected Automatically

• Usage Data: Information about how you interact with our Service, including features used, designs generated, and time spent on the platform.
• Device Information: Browser type, operating system, device type, and IP address.
• Cookies: We use essential cookies to maintain your session and preferences.
• Client Portal Visitors: When visitors access a shared project portal, we collect their name (if they leave a comment), a randomly generated device identifier stored in their browser, and IP address for rate limiting purposes.

3. AI Processing and Your Content

Our Service uses artificial intelligence to generate landscape designs based on your photos and descriptions.

3.1 Third-Party AI Processing

Your photos and prompts are processed by the following AI services:

• Google Gemini (via Google AI Studio): Text and image generation. Google's data usage is governed by the Google AI Studio Terms of Service. Google may use API inputs to improve its services as described in its terms.
• Google Imagen (via Vertex AI): Image inpainting. Governed by the Google Cloud Terms of Service. Customer data is not used to train models under the paid Vertex AI data processing terms.
• Cloudflare Workers AI: Text prompt processing only (no images are sent). Governed by Cloudflare's Terms of Service.

We recommend reviewing each provider's terms to understand how your data may be handled.

3.2 Storage and Retention

• Storage: Your uploaded photos and generated designs are stored securely in cloud storage (Cloudflare R2) associated with your account.
• Retention: Your content remains in your account until you choose to delete it or close your account.

3.3 AI Training

No Training by Yard Designer: We do not use your personal photos or designs to train our own AI models. However, third-party AI providers may process your content according to their own terms as described above. We encourage you to review their policies.

4. How We Share Your Information

We do not sell your personal information. We may share your information with:

• Service Providers: Third-party vendors who assist us in providing the Service, including:
  • Google Gemini and Vertex AI (AI design generation and inpainting)
  • Cloudflare Workers, R2, and Workers AI (hosting, storage, edge computing, prompt processing)
  • Stripe (payment processing)
  • Turso (database hosting)
  • Resend (transactional email delivery)
  • Google OAuth (authentication, if you choose Google sign-in)
  • Google Analytics (website analytics — only with your consent)
  • Google Ads (advertising measurement — only with your consent)
• Legal Requirements: When required by law, subpoena, or other legal process.
• Business Transfers: In connection with a merger, acquisition, or sale of assets.

Data Retention

Account data is retained until you request deletion. Usage logs are retained for 90 days. Payment records are retained for 7 years as required by law. AI-generated images are retained until you delete them or close your account.

Exercising Your Rights

To exercise any of these rights, email contact@yarddesignerai.com or use the account deletion feature in your Settings page. We will respond to verifiable requests within 45 days.

10. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, including the United States. These countries may have data protection laws that are different from your country. We ensure appropriate safeguards are in place to protect your information in accordance with this Privacy Policy.

11. Children's Privacy

Our Service is not directed to children under the age of 16. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and believe your child has provided us with personal information, please contact us and we will delete such information. The client portal is intended for users 16 years of age and older.
